Service terms
The short version
- The preview is free, and you're under no obligation to go ahead.
- If you do, it's $69 a month with no setup fee and no lock-in. Cancel any time, and your site stays live until the end of the month you've paid for.
- Your domain is registered in your business's name and stays yours.
- If you leave, you get a copy of your website's files to take with you.
These terms are between you (the business I build a website for) and me, James Lemon, ABN 57 339 104 054, a sole trader based in Moreton Bay, Queensland. They apply when you accept them, by agreeing in writing or by paying for the service. If anything here is unclear, ask me before you sign up.
1. The free preview
I may build a preview of a website for your business before you've asked me for anything, using information that's publicly available, such as your business listing. A preview:
- costs you nothing and doesn't commit you to anything;
- is shown at an unlisted web address, is hidden from search engines, and is labelled as a concept that isn't affiliated with your business;
- never uses your logo or photos without your permission;
- is removed after about 30 days, or sooner if you ask.
2. What the service includes
- Your website: designed and built for your business, up to 10 pages.
- Hosting: on Amazon Web Services in Sydney, with HTTPS security on every page.
- An enquiry form: enquiries are emailed to you. Copies are kept for 90 days and then deleted (see the privacy policy).
- Your domain name: registered and renewed for you while you're subscribed (see section 5).
- Small changes: such as updating text, prices, hours, services, photos or contact details. Send me a message and I'll usually make them within 2 business days.
Bigger work, such as extra pages beyond 10, a redesign, online booking or payments, is not included. I'll always tell you the price first, and I won't charge you for anything you haven't agreed to.
3. Price and payment
- The price is $69 a month, with $0 setup.
- You pay monthly in advance by card through Stripe, starting on the day you sign up. Stripe emails you a receipt each month. I never see or store your card details.
- I'm not registered for GST, so no GST is charged. If I register for GST in future, I'll give you at least 30 days' notice of any change to what you pay.
- I may change the price, but only with at least 30 days' written notice. If you don't want to pay the new price, you can cancel before it starts.
4. Cancelling
- There's no minimum term. You can cancel at any time, either through the billing page (also linked in your Stripe emails and the footer of this site) or by messaging me.
- Your site stays live until the end of the month you've already paid for, and you won't be charged again. There are no refunds for part of a month.
- I can end the service by giving you at least 30 days' notice, for example if I stop offering it. If I do, everything in section 6 still applies.
5. Your domain name
- Your domain is registered in your business's name. For a .com.au, that means using your ABN. You are its registered owner, and I manage it on your behalf. I register it when you sign up, and renew it automatically while you're subscribed.
- While you're subscribed, the registration and renewal cost of one domain is included in your monthly price. That covers a new .com.au, .au or .com domain at the standard price (usually under $30 a year). A premium-priced domain, a domain bought from someone else, or extra domains aren't included. If you want one, I'll tell you the cost first, and you pay the difference.
- If you already own a domain, you keep it. I'll either point it at your new website or, with your agreement, transfer its management to me. Before changing anything, I'll copy across any existing settings, such as your email, so they keep working.
- If you leave, I'll give you the domain's transfer code and you can move it to any provider. From then on, renewals are up to you.
- I register and manage domains through Synergy Wholesale Pty Ltd (ABN 17 165 245 901), the registrar for your domain. You may receive emails about your domain, such as renewal notices, from noreply@jameslemon.com.au.
- As the domain's registered owner, you agree to follow the rules for your domain: auDA's licensing rules for .au domains, and ICANN's rules for domains such as .com (see ICANN's registrant benefits and responsibilities and registrant educational information).
- You authorise me to act as your Designated Agent, which means I can approve changes to your domain's registrant contact details for you. I'll only do this to carry out changes you've asked for.
- If a domain expires after you leave and you ask me to restore it, the fee to restore a .com, .net or .org domain is $150. Restoring a .au domain within its grace period has no extra fee.
6. When you leave
- Your content is yours: the text, photos, logos and other material you've given me.
- You get your website: if you ask within 30 days of leaving, I'll send you a copy of your website's files as they were when you left. You can have it hosted anywhere and changed by anyone. After you leave I won't maintain or support it.
- Enquiries stored by the enquiry form are deleted on their normal 90-day schedule.
7. Your responsibilities
- Give me accurate information about your business, and tell me if something on your site becomes wrong.
- Only give me material you have the right to use, and only ask me to say things you can back up (for example licence numbers, response times or warranties).
- Reply to the enquiries your website receives. They're your customers, and the form only passes their details on to you.
- Keep your contact details with me up to date, so I can reach you about your site and domain.
8. My responsibilities
- Build and look after your website with reasonable care and skill.
- Keep it running, secure and up to date. Like any website it may occasionally be unavailable for short periods, for example during maintenance or an outage at a provider. I'll fix problems as quickly as I reasonably can.
- Keep your information private, as set out in the privacy policy.
- Tell you honestly what is and isn't included before you pay for anything.
9. Images on your website
Unless you supply your own photos, some images on your website may be illustrations created with AI tools or licensed stock images. They are chosen to suit your trade and area, never show people presented as you or your staff, and can be swapped for your own photos at any time as a small change.
10. Ownership of the design and code
I keep ownership of the tools, templates and code I use to build websites, so I can keep using them for other clients. You can use your website, and the copy you receive if you leave, for your business, forever and at no extra cost.
11. Late payment
If a payment fails, Stripe will try again and let you know. If a payment is more than 14 days overdue, I'll contact you first, and may then take your website offline until it's paid. Your domain stays yours either way.
12. Liability
- Nothing in these terms takes away rights you have under the Australian Consumer Law.
- I'm not responsible for losses that I didn't cause or couldn't reasonably have foreseen, or for problems caused by information or material you gave me.
- Apart from those rights under the Australian Consumer Law, my total liability to you is limited to the amount you've paid me in the 3 months before the issue arose.
13. Changes to these terms
If I change these terms, I'll tell you at least 30 days before the changes apply to you. If you don't agree with them, you can cancel before they take effect.
14. Other things
- These terms are governed by the laws of Queensland.
- If we disagree about something, we'll first try to sort it out by talking.
- For anything about these terms, use the form on the home page.
